They trigger anterograde amnesia, which erases new memories. This is exactly what perpetrators want: they want victims not to remember recent events – in 99% of cases, sexual assault.

Unfortunately, the clearance rate for such crimes is still too low because targeted toxicological examination is rarely conducted when there is suspicion. Especially in emergency rooms, there is often time pressure, and people with memory problems are sometimes sent home without comprehensive examination because their story sounds too bizarre or because alcohol is assumed to be the cause. This causes valuable time for evidence to elapse.

What Substances Are We Talking About?

More than 30 different substances have already been detected through functioning drug testing kits. The top list includes:

  • Ketamin

Evidence of GHB and its precursor GBL abuse has existed since the late 1990s. However, drug-laced drinks were likely used earlier. This substance is also produced naturally through our metabolism. GHB resembles the inhibitory neurotransmitter GABA (gamma-aminobutyric acid). There is prescription-only synthetic GHB, but the precursor substance GBL is also relatively readily available without a prescription because it is a basic chemical industry material.

Those with chemical knowledge can make GHB from it, which is crystal clear and odorless. It only tastes slightly salty, but the cocktails that perpetrators pour the drug-laced drinks into mask this taste. They generally have a dampening effect. The effects set in after 15 to at most 30 minutes. The substance initially causes relaxation and can lead to unconsciousness at higher concentrations. The risk of overdose is always potential because there is only a small safety margin between a dose with the desired effect and a life-threatening one.

Forensic toxicology at German universities regularly deals with drug-laced drink cases. Toxicologists point out that there may be other causes for the described symptoms, but they always recommend appropriate testing. Sexual crimes were not the only ones prepared with drug-laced drinks—robberies and, more rarely, murders were also prepared this way. However, such cases occur far less frequently than sexual assaults on women.

How Does the Legislator Handle Drug-Laced Drinks?

Generally, perpetrators, if identified, are prosecuted for assault and, with appropriate evidence, for rape or other crimes. However, both investigations and criminal evidence are usually unsuccessful. Therefore, the U.S. state of California has taken a different path since 2024: A new law mandates that operators of nightclubs, bars, festivals, and other events open to the public must offer drug testing kits.

The California model (since July 2024) has two positive effects:

Other countries are watching California's developments and considering similar measures. There is currently no legal requirement in Germany, but various clubs and organizers offer tests voluntarily.

How Can Drug-Laced Drinks Be Tested?

The drug-laced drink wristband has existed for some time, but it faces criticism from experts and scene professionals. It has a test field that is supposed to detect GHB in a drink. However, there are several problems:

However, there are reasonable suppliers who sell the drug-laced drink wristband but don't overpromise. They point out that a drug-laced drink wristband promotes personal awareness and can also deter potential perpetrators. These are good arguments, but they don't help against the actual effects of drug-laced drinks.

The DrinkCheck Drug Test – A More Reliable Alternative

The DrinkCheck rapid test for drug-laced drinks (ketamine and GHB) is a significantly more reliable test strip compared to the drug-laced drink wristband. An invaluable advantage of test strips is their safe storage in packaging until the moment of use. Wristbands, of course, are exposed to various contaminants in the air, which ultimately make them virtually unusable.
